Photo Poodle is operated by Olters Meedia OÜ, registered in Estonia.

1. Agreement to Terms

By accessing or using Photo Poodle, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.

2. Use License

Photo Poodle grants you a personal, non-transferable, non-exclusive license to use the platform for creating and managing photo collection events. You may not:

• Modify or copy the platform materials
• Use the platform for any commercial purpose without proper authorization or subscription
• Attempt to reverse engineer any software contained on Photo Poodle
• Remove any copyright or proprietary notations from the materials

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding your account password and for any activities or actions under your account.

4. Content Ownership

You retain all rights to the photos, videos, and content uploaded to Photo Poodle. By uploading content, you grant us a license to store, display, and distribute your content solely for the purpose of providing our services. We will never use your photos or videos for marketing or any other purpose without your explicit permission.

5. User Responsibilities

Users are responsible for:

• Ensuring they have rights to upload and share all content
• Obtaining necessary permissions from event attendees
• Not uploading inappropriate, offensive, or illegal content
• Respecting copyright and intellectual property rights
• Complying with applicable data protection laws when collecting guest contact details

6. Subscription and Payments

Photo Poodle offers both free and paid plans:

• Puppy (Free): 1 event, up to 50 photos, 1 week storage
• Good Dog (€39 / $45 per event): 1 event, up to 300 photos + videos, live photo wall, AI generator, event branding, Memory Album, 1 month storage
• Best in Show (€85 / $99 per event): 1 event, unlimited photos + videos, everything in Good Dog, 3 months storage
• Pack Leader (€199 / $230 per month): Unlimited events, unlimited uploads, team members, white-label, 1 year storage

Good Dog and Best in Show are one-time per-event purchases that do not auto-renew. Pack Leader is a recurring monthly subscription. By purchasing a plan, you agree to pay all fees associated with your chosen plan. Payments are processed securely through Stripe. All fees are non-refundable except as stated in our Refund Policy.

Fair Use of "Unlimited" Plans. Plans described as offering "unlimited" photos or uploads (including Best in Show and Pack Leader) are subject to a fair-use limit of 10,000 files per event. This limit exists to protect the integrity and performance of our shared infrastructure, to prevent automated or abusive use (such as bots, scraping, or bulk archival unrelated to a genuine event), and to ensure reliable service and storage availability for all customers. The limit comfortably accommodates real-world events of any typical size. If your event legitimately requires a higher volume, please contact us directly at support@photopoodle.com before or after purchase and we will make reasonable arrangements to accommodate your needs.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the service at any time.

8. Limitation of Liability

Photo Poodle (Olters Meedia OÜ) shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will immediately cease.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes. Continued use of the service after changes constitutes acceptance of the new terms.

11. Intellectual Property

The Photo Poodle platform, including its design, software, branding, features, and all associated intellectual property, is owned by Olters Meedia OÜ and protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or trade names. You retain ownership of the photos, videos, and content you upload (see Section 4); we claim no ownership over your user content.

12. Disclaimer of Warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free. We do not warrant that any errors or defects will be corrected, or that the service is free of harmful components. No advice or information provided by us creates any warranty not expressly stated here.

13. Third-Party Services

The service integrates with third-party providers, including Stripe (payment processing), Google (analytics), and cloud hosting infrastructure. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or content of these third parties, and you acknowledge that their terms may differ from ours.

14. User-Generated Content & Copyright

Photo Poodle hosts user-generated content (photos, videos, captions). You are solely responsible for the content you and your guests upload and must ensure it does not infringe the rights of any third party, including copyright, privacy, and personality rights.

If you believe that content on Photo Poodle infringes your copyright, you may submit a takedown request to support@photopoodle.com including: identification of the copyrighted work, the location of the infringing material, your contact details, and a good-faith statement that the use is not authorised. We will process valid requests in accordance with applicable law.

15. Age Requirement

You must be at least 16 years old to create an account and use Photo Poodle. If you are under 18, you confirm that your legal guardian has reviewed and agreed to these Terms on your behalf. Event guests who upload photos are not required to create an account, but the event organiser is responsible for ensuring appropriate consent is obtained from all participants, including minors.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government actions, pandemics, labour disputes, or failures of third-party infrastructure (including internet, hosting, or payment providers).

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising from or relating to these Terms or the service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved amicably within 30 days, it shall be submitted to the exclusive jurisdiction of the Estonian courts, with Harju County Court as the court of first instance, unless mandatory EU consumer protection law requires otherwise.

Consumers in the European Union may also use the European Commission's Online Dispute Resolution platform available at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration body, but we will assess such requests on a case-by-case basis.
